What The End Of The ELD Grace Period Means For You

Several months ago the Federal Motors Carrier Safety Administration (FMCSA) issued a grace period for the ELD Mandate, which will be ending in the upcoming weeks. Carter is here to help make sure your business is ELD compliant, by providing you with important information on how this change may affect your business.

The ELD Mandate, instated in December 2017, requires businesses to use electronic logging device to track and monitor the hours their commercial drivers have spent on the road. Since coming into effect, the mandate has sparked widespread confusion due to exemptions concerning what businesses must comply. In addition, inconsistent enforcement by police officers has further added to this confusion. To help with this transition, the FMCSA issued a grace period extending through April 1, 2018.

What You Need To Know:

Effective Date
December 18, 2017 – April 1, 2018

Outcome
Drivers who fail to use an electronic logging device during the grace period will NOT be placed out of order. However, they are still subject to a citation. After April 1st, drivers who fail to comply with the ELD Mandate will be subject to normal consequences, and may be placed out of order.

Exemptions & Additional Information

  • Agriculture: Starting Dec. 18th, agricultural product transporters have a 90-waiver, exempting them from having to comply with the ELD Mandate.
  • Automatic Onboard Recording Device (AOBRD): Drivers currently using an AOBRD device will have until December 2019 to adopt an ELD Device, and are exempt from ELD compliance until then.
  • Personal Conveyance: In several weeks, the FMCSA will release a statement regarding guidance for Personal Conveyance, which allows drivers to use a commercial vehicle for their personal use without this being counted against their available on-duty drive time.
